Romania: Legislative and Tax Update | November 2026

With year-end approaching, companies in Romania should review their tax, payroll and reporting processes against recent legislative and tax updates. Some of the rules covered below already apply, while others, such as the new savings and investment accounts will shape decisions for next year.

VAT refunds: documentation still matters

Recent ANAF procedural updates concerning VAT returns with refund options are a reminder that a refund claim is only as strong as the records supporting it. For companies with significant input VAT, a timely reconciliation between the VAT return, accounting ledger, purchase documentation and electronic invoice data can prevent avoidable follow-up questions.

We recommend keeping the supporting file up to date as part of the monthly close, rather than assembling it only when the tax authority asks for it.

RO e-Factura: checking the process behind each submission

RO e-Factura has become part of day-to-day business administration. Yet errors often arise before an invoice reaches the platform: incorrect customer details, inconsistent VAT treatment or gaps between invoicing and accounting software. These issues are particularly visible in groups using several systems or processing invoices centrally outside Romania.

November is a useful time to check who monitors rejected documents, how corrections are handled and whether the information in the e-Factura system matches the general ledger. Invoices must generally be transmitted within five working days of issue, with specific rules for certain transactions.

Payroll: review the details before year-end

For eligible employees paid at the statutory minimum wage, the fiscal rules applicable in the second half of 2026 provide for a RON 200 monthly amount excluded from income tax and mandatory social contributions, subject to legal conditions. Employers should not apply this treatment automatically to every minimum-wage employee without testing eligibility.

Beyond this measure, employers should review benefits, variable payments, leave records and payroll reconciliations. For international employers and EOR (Employer of Record) arrangements, clear responsibilities between the client, local employer and payroll provider remain important.

Looking ahead: savings and investment accounts

Law No. 202/2026 introduces a framework for savings and investment accounts, with provisions scheduled to apply from 1 January 2027. Employers considering contributions as part of a benefits package should first examine the detailed conditions, limits and payroll treatment rather than if all contributions will receive favourable tax treatment.

HR and finance teams should plan for this over the coming months and carry out a legal and tax review before implementing any changes.

Corporate tax and the 2026 close

The final weeks of the year are often when unresolved items become more difficult to fix. Intercompany balances, supporting invoices, provisions, fixed assets and expense deductibility should be reviewed while there is still time to obtain missing information. Groups reporting under IFRS or another group standard should also identify local statutory adjustments early.

A short review now can make the year-end close more predictable and reduce the number of late questions between local finance teams, group reporting and external advisers.

What we suggest companies do in November

Rather than treating compliance as a year-end exercise, we encourage businesses to use November for a targeted health check: reconcile VAT and electronic reporting data, review payroll exceptions and benefits, identify outstanding intercompany documentation, and assign owners to any open year-end issues.

Eurofast Take

Eurofast Romania supports local companies and international groups with accounting, tax compliance, payroll, HR and Employer of Record services, and can carry out a targeted year-end health check covering VAT, e-Factura, payroll and intercompany documentation. We can also advise employers on whether and how to include the new savings and investment accounts in their benefits packages from 2027
